These Terms & Conditions (“Terms”) govern your use of driftstreams.com and the DriftStreams platform and services, operated by Leftrock Design Inc. (“DriftStreams,” “we,” “us,” or “our”). By accessing our site or using our services, you agree to these Terms. If you do not agree, do not use the site or the services.

1. Who We Are

DriftStreams is a technology platform for audience targeting and content syndication, operated by Leftrock Design Inc., 6 St Johns Ln, New York, NY 10013. Questions about these Terms can be sent to legal@driftstreams.com.

2. Access and Eligibility

Access to the DriftStreams platform is invite-only and is provided to businesses and their authorized personnel. You must be at least 18 years old and capable of forming a binding contract. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account, and you agree to notify us promptly of any unauthorized use.

3. Acceptable Use

You agree not to:

Use the services in violation of any applicable law or regulation.
Attempt to gain unauthorized access to the services, other accounts, or our systems or networks.
Interfere with, disrupt, probe, or place undue load on the services or their infrastructure.
Reverse engineer, decompile, scrape, or attempt to extract the source code or underlying data of the services except to the extent that restriction is prohibited by law.
Submit or generate fraudulent, invalid, or artificially inflated traffic, impressions, clicks, or events.

We may suspend or terminate access at any time for conduct we reasonably believe violates these Terms or is harmful to us, our partners, or other users.

4. Mobile Messaging (SMS) Program Terms

These terms apply to the DriftStreams SMS alerting program. By providing your mobile number and consenting to receive messages, you agree to the following.

Program Description

DriftStreams sends operational and system alerts by SMS to authorized personnel of Leftrock Design Inc. and its clients who have provided their mobile number and consented to receive them. Messages notify recipients of events such as a data pipeline that has stopped recording, an advertising campaign that has been automatically paused by our monitoring, a service outage, or a security event on our platform. This program does not send marketing or promotional messages.

How to Opt In

There is no public sign-up. Mobile numbers are added to the alerting configuration only by an authorized account administrator, who obtains consent directly from each recipient before adding their number. We do not send messages to any number that has not been explicitly configured in this way.

Message Frequency

Message frequency varies and depends on system activity. Messages are sent only when a monitored event occurs. In typical operation, recipients receive fewer than 10 messages per month.

Cost

Message and data rates may apply. DriftStreams does not charge for these alerts, but your mobile carrier’s standard messaging and data rates will apply according to your plan.

How to Opt Out

To stop receiving messages at any time, reply STOP to any message from us. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. You will receive a single confirmation message and will not receive further messages from this program. To rejoin, ask your account administrator to re-add your number.

For help, reply HELP to any message from us, or contact us at support@driftstreams.com. Replying HELP returns our contact information and opt-out instructions.

Carriers and Delivery

Delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use-case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See our Privacy Policy.

5. Intellectual Property

The services, including all software, text, graphics, logos, and other content we provide, are owned by Leftrock Design Inc. or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the services for your internal business purposes, subject to these Terms. No other rights are granted.

6. Third-Party Content and Links

Our site and services may contain advertising, content, and links to properties we do not control. We are not responsible for the content, policies, or practices of any third party. Your dealings with third parties are solely between you and them.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the services will be uninterrupted, timely, secure, or error-free, or that alerts will always be delivered.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEFTROCK DESIGN INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You agree to indemnify and hold harmless Leftrock Design Inc. and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the services, your content, or your violation of these Terms or of any law or third-party right.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York, for any dispute arising out of or relating to these Terms or the services.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the services after changes take effect constitutes acceptance of the revised Terms.
